Midwest ISO Protests as Illinois Power Drops Out

LCG, Nov. 6, 2000--The Midwest Independent System Operator, stung last week when Commonwealth Edison Co. jilted it in favor of the Alliance Regional Transmission Organization, protested Friday when Illinois Power Co. announced it would follow ComEd out the door.

The Midwest ISO on Friday asked the Federal Energy Regulatory Commission to reject Illinois Power's notice to FERC that it would withdraw from the ISO, saying that the utility lacks legal authority to withdraw within the period of time the company specified in its notice.

The ISO motion said "Irrespective of whether Illinois Power has contractual authority to file to withdraw, the Commission should not grant such application unless it finds that withdrawal is in the public interest, i.e., whether reliability, competition and the interest of consumers will be enhanced by such action."

When ComEd dropped out, the Midwest ISO pretty much lost Illinois. The loss of Illinois Power would make it complete. That has the ISO sufficiently worried that it is willing to become whatever the utilities want. In its motion it said "if form of corporate organization is a factor motivating departure fromthe Midwest ISO or even active consideration of departure by transmission owning members, thenthe form of organization can be changed."

Noting that its losses are headed for the Alliance RTO, a profit-oriented operation, the Midwest ISO told FERC that it is "open to the possibility to transform itself into a for-profit entity if that transformation can further the creation of an even broader Midwest Regional Transmission Organization."
