Judge Extends Must Sell Order in California

LCG, Feb. 8, 2001Judge Frank Damrell in the U.S. district Court in Sacramento yesterday evening extended his order forcing Reliant Energy Inc. to sell electricity to the California independent System Order. The extension will stay in force until this afternoon.

Judge Darnell had on Tuesday issued his temporary restraining order just hours before a federal emergency order requiring the sales was to expire.

Reliant spokesman Richard Wheatley said his company is worried it might not get paid due to the near insolvency of the state's two biggest utilities, Pacific Gas & Electric Co. and Southern California Edison Co. Reliant want the California Department of Water Resources to stand behind Cal-ISO's power purchases.

Cal-ISO's original lawsuit, in which Judge Damrell granted his order, had also included AES Pacific Inc. and Dynegy Power Co., but those two companies were not covered by the restraining order because they said they would continue to deliver power pending this afternoon's expected ruling.

AES and Dynegy said their plants were nearing the limits of their annual emissions allotments and would exceed them if forced to operate. But Cal-ISO said it would lose about 4,000 megawatts if the three companies quit supplying power. Without that power there would be a high risk of blackouts, the ISO said.
