California a Loser in Congress Energy Votes

LCG, Aug. 2, 2001The U.S. House of Representatives yesterday disappointed California lawmakers who tried to slip into a broad energy bill a requirement that the Federal Energy Regulatory Commission impose more stringent price controls on electricity sold in the West.

An amendment to the energy bill, offered by Rep. Henry Waxman, D-Calif., Would have required FERC employ once-prevalent cost-plus ratemaking to set electricity prices. It was voted down 274-154.

Rep. Joe Barton, R-Texas, said the proposed restriction amounted to a price cap that isn't needed because California "is getting its act together" and could deter companies from investing in new power plants.

Waxman said that existing FERC regulations aren't working, though they are widely credited for reining in high electricity prices not only in California but throughout the West.

He was supported by Rep. Anna Eshoo, also a Democrat, who grumped "We don't trust the FERC."

California also lost out on a bid to gain exemption from a federal requirement that gasoline contain a 2 percent oxygen additive. The additive currently in use, MTBE, has been found to invade ground water and is a suspected carcinogen. It is to be replaced by ethanol, which is being pushed by Iowa and other corn-growing states.

California has asked for a waiver from the ethanol requirement, but was voted down 300-125. "All we get is some crumbs for California," complained Rep. Bob Filner.
