Feds Probe Pennsy Power Prices
Dec. 20, 2001--The U.S. Department of Justice has asked PJM Interconnection LLC, which administers the wholesale power market in Pennsylvania and other mid-Atlantic states, to turn over documents and computer files related to electricity sales between Jan. 1, 1999, and the end of this year, The Allentown (Pa.) Morning Call reported this morning.PJM officials have until Jan. 4 to comply with the government's 10-page request which also asked for correspondence regarding concerns about anti-competitive forces or market manipulation, including its impact on retail electricity prices.The target of the federal investigation may be PPL Corp. of Allentown, coming as it does less than a month after the Pennsylvania Public Utility Commission launched its own investigation into allegations that PPL made millions earlier this year by unfairly manipulating wholesale energy prices.PJM, which manages electric transmission and the wholesale power market in Pennsylvania, New Jersey, Maryland, Delaware, Washington, D.C., and a portion of northern Virginia, said last month in a report submitted to the PPUC that PPL's wholesale marketing unit PPL EnergyPlus exercised "undue market power" from January to March, intentionally withholding some of its generating capacity to boost wholesale prices.PPUC spokesman Tom Charles said that, depending on where the investigation led, evidence could be turned over to the state attorney general, the Federal Energy Regulatory Commission or the Justice Department. Pennsylvania Consumer Advocate Sonny Popowsky, who represents the interest of utility customers before the PUC, said he believes the federal investigation is much wider than the state probe."As far as I can tell, it doesn't seem to be limited to PPL or that one three-month period," Popowsky told the Morning Call. "This (wholesale) market has been a problem for a long time, and the question is whether there were antitrust violations some attempt to monopolize the market or fix prices.""(Consumers) didn't gain the benefits of competition that might have occurred had the wholesale capacity market operated more efficiently," Popowsky said. "A lot of (electricity suppliers) left the market because they were paying more at wholesale than they could charge at retail."
