Merchant Plants' Siting May Be Regulated in Kentucky

LCG, Mar. 21, 2002--A bill passed unanimously by the Kentucky Senate that would give local decision-makers greater control over merchant plant siting will now be considered by the House.

Kentucky has received 29 applications since 1999 for the building of merchant power plants. Lawmakers have expressed concern that low prices offered by Kentucky utilities would lead the plants to sell all of their power out-of-state, offering little benefit to Kentucky.

Sen. Ernie Harris, R-Crestwood, is the sponsor of Senate Bill 257, which also requires an environmental impact study for regulated and merchant plants at the local level. A siting board would be mandated to consider local input on siting decisions.

Tom Fitzgerald, of the Kentucky Resources Council, said that while he approves of Senate Bill 257's treatment of siting approval for new plants, he would like expansion decisions at existing plants to be subject to review as well.

A lobbyist for the Kentucky Association of Electric Cooperatives, Hayden Timmons, speculated that the bill's passage in the Senate raised the likelihood that the House would approve it, although House Democrats and Senate Republicans are not yet unified.
