FERC Finds Entergy Bidding Process Not Competitive
LCG, Mar. 22, 2004--The results of bidding by generators to gain access to utility Entergy Corp.'s transmission system showed undue consideration for affiliates, analysts with the Federal Energy Regulatory Commission testified last week.Entergy gave 76 percent of network transmission capacity to entities with which it had no corporate ties, and 20 percent to affiliates, according to filings it made with the agency. A spokesman for Entergy told Reuters that an independent analyst oversaw the manner in which bids were awarded. Generators including Calpine Corp., TECO Energy and Tractebel Energy Marketing have asserted that Entergy did not treat all bids fairly.FERC's James Ballard wrote that Entergy Services Inc., the subsidiary handling the bids, "did not adequately analyze the ... bids with respect to transmission system impacts and their related cost implications." Sabine Joe, the other analyst who testified, said she believe Entergy had "committed affiliate abuse."The agency began investigating last year, due to questions about affiliate transactions and competition. FERC Judge Brenner will preside at a formal hearing on June 15.
